This course provides a basic introduction to those concepts and terminology likely to be encountered when German lawyers confront the Common law system. Using a variety of both printed and audiovisual materials, in additional to role playing and other interactive exercises, students will learn important legal terms and the context for using these terms in writing and discussion.

Beschreibung

This course covers general legal terminology used in court and in legal practice by lawyers in the United States (U.S.). The legal system in the U.S. is largely based on common law. This course examines, defines and provides an overview of the historical development of the common law and the civil law system. The doctrine of ''stare decisis'' is closely looked at. This course also covers the three (3) branches of the U.S. Government, the structure of the court system, jurisdiction, and the role of the Chief Justice in the American legal system. This course will provide an overview of the American Bill of Rights and James Madison. Basic skills such as summarizing and citing a legal case are taught. Civil Procedure in the U.S. and Professional Ethics form part of the course.

This course focuses on applying correct English style and grammer when drafting legal documents, particularly contracts, irrespective of the subject matter (sales, confidentiality, technology licensing) or governing law involved. Students will be made familiar with the correct use of syntax, tense forms, active and passive voices, relative clauses and adverbial and prepositional phrases to express the language of: Performance, Obligation, Discretion, Prohibition, Policy, Conditions, Representation. Students will be required to interpret and draft a number of documents using simulated case studies and requires time both in and out of class.

Beschreibung

The purpose of this course is to familiarize students with substantive and practical differences between purely domestic and cross-border business transactions. The course focuses on legal issues specific to transactions between companies doing business in common law and civil law systems, such as local formalization requirements, exchange control restrictions, foreign investment approvals, and litigation issues. Students also gain a general understanding of the issues arising in connection with the negotiation of international contracts extending from an initial NDA to a sophisticated merger transaction.

The course will focus on software law issues in an international context. Matters to be explored include: Similarities and differences between the various forms of IP that can be used to protect software (copyright, patent, know-how); software development topics; open source software; data use rights, software as a service (SaaS) and other cloud models.

This course is a foundational course on the rights of children. The United Nations Convention on the Rights of the Child (UNCRC), the four core principles of the convention, the Optional Protocols and the work of the Committee on the Rights of the Child (CRC) will be covered. The history of children’s rights in international human rights law, the standards and resources required to protect children form part of the curriculum. Specific topics will include children’s rights to participation and their rights to global health. The international case law will be discussed.

Tort law is concerned with civil wrongs. Undoubtedly the largest (and most dynamic) area of law within tort is the law of negligence. This course covers the definition of tort, the fundamental principles of tortious liability, the main torts, remedies and defences available, and specific terminology used in the law of tort. This course will also examine leading cases and international cases in the law of tort.

Beschreibung

This course is designed to provide law students with the opportunity to develop trial skills in the courtroom. This basic Trial Advocacy course focuses on fundamental skills such as delivering opening statements and closing arguments, the art of direct examination, how to cross-examine witnesses, and the introduction of exhibits. In this course, students learn by experience, acting as trial counsel to practice specific courtroom skills which is done through mock trials. The usual order of a trial and courtroom ethics will be covered. The course includes jury selection in the United States (U.S.), witnesses, and some basic rules of the Law of Evidence.

Civil Procedure is the part of law that sets out the rules and standards courts follow when adjudicating civil lawsuits. This course focuses on the Federal Rules of Civil Procedure (FRCP) in the United States (U.S.) that govern how a lawsuit or case may be commenced, the summons, the requirements of service of process, the types of pleadings and motions, discovery and depositions, pre-trial conferences, the trial, the judgment, and the right to appeal. Jurisdiction and the American Courts will be examined. This course will also cover the pre-litigation stage which will focus on the first consultation, the initial demand and the lawyers letter.

This course focuses on human rights issues and how these issues are being operationalized through new legal instruments that focus on the obligations of companies to provide transparency on their efforts to assure compliance throughout their supply chains.

We will look into the various regulations that have historically contributed to the protection of human rights and how the legislative discussions have progressed in Germany and Europe, with a particular focus on the German “Supply Chain Due Diligence Act” (“LkSG”) and the recently announced European Corporate Sustainability Due Diligence Directive (“CSDDD” or “CS3D”).

Students will be asked to contribute during this course with presentations on some of the central issues of these new regulations such as the development of risk assessments, reporting requirements and processes designed to deal with complaints such as whistleblowing mechanisms.

The course will focus on recent U.S.Supreme Court decisions to help students read and understand English terminology and analysis in Court opinions of current interest. Topics will include: separation of church and state, gun regulation vs. freedom of ownership and use, continuing tension over rights of the embryo vs. reproductive choice, the extent to which the government may regulate social media content compatible with freedom of expression, constitutionality of punishing homeless encampment on public property when housing is not provided, and regulation of immigration. The class will examine interpretation ofthe relatively few constitutional provisions that relate to the judicial opinions of a divided Supreme Court on these topics. Detailed study of realistic business situations reinforces the students' ability to analyze information and make appropriate projections, thus entering a negotiation or another kind of meeting fully prepared. This course aims at familiarising students with the key skills and competencies associated with successful careers in the globalised world: from internships in multinational companies, placements abroad, to international positions involving work in cross-cultural environments. It will prepare participants for what to expect when applying for jobs in the global, competitive marketplace.
In particular, we will discuss, assess, and identify ways of individual improvement of such skills as:
